Capitalized terms, unless otherwise defined, have the meaning specified within the Definitions section below.
This Terms of Service, along with our Privacy Policy, Payment Policy, End User license Agreement "EULA", any mobile license agreement, and other posted guidelines within the Service, collectively "Legal Terms", constitute the entire and only agreement between you and Kamshare, and supersede all other agreements, representations, warranties and understandings with respect to the Service and the subject matter contained herein.
We may amend our Legal Terms at any time without specific notice to you. The latest copies of our Legal Terms will be posted on www.Kamshare.com/legal, and you should review all Legal Terms prior to using the Service.
After any revisions to our Legal Terms are posted, you agree to be bound to any such changes to them. Therefore, it is important for you to periodically review our Legal Terms to make sure you still agree to them.
By accessing the Service, you are agreeing to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.
You should also read the Privacy Policy, EULA and the Payment Policy which are incorporated by reference into this Agreement and available in the Service. If you do not agree with any of these terms, do not use the Service. The materials contained in the Service are protected by applicable copyright and trademark law.

This Agreement is an electronic contract that establishes the legally binding terms you must accept to use the Service. This Agreement includes Kamshare Corp's Privacy Policy, Payment Policy, EULA and terms disclosed and agreed to by you if you purchase or accept additional features, products or services we offer on the Service, such as terms governing features, billing, free trials, discounts and promotions.
By accessing and/or using the Service, you accept this Agreement and agree to the terms, conditions and notices contained or referenced herein and consent to have this Agreement and all notices provided to you in electronic form. To withdraw this consent, you must terminate your account and cease using the Service.
The terms "us" or "we" or "our" refers to Kamshare Corp, the owner of the Service.
A "Visitor" is someone who merely browses the Service.
A "Member" is an individual that has registered with us to use our Service and/or has downloaded or accessed the Service.
Our "Service" represents the collective functionality and features as offered by Kamshare Corp to our Members.
A "User" is a collective identifier that refers to either a Visitor or a Member.
All text, information, graphics, audio, video, images and data offered, posted, copied, uploaded, downloaded and/or shared through the Service are collectively known as "Content".
License terms are contained on our EULA.
How we collect, protect and use your Data and certain other information about you are contained in our Privacy Policy.
Any monetary transaction you conduct through the Service are subject to the Payment Policy.
No part of Kamshare is directed to persons under the age of 13. You must be at least 13 years of age to access and use the Service. Any use of the Service is void where prohibited. By accessing and using the Service, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
If you create an account, you represent and warrant that you have never been convicted of a felony and that you are not required to register as a sex offender with any government entity.
Using the Service may be prohibited or restricted in certain countries. If you use the Service from outside of the United States, you are responsible for complying with the laws and regulations of the territory from which you access or use the Service.
In order to use the Service, you must sign in using your Facebook login. If you do so, you authorize us to access and use certain Facebook account information, including but not limited to your public Facebook profile and information about Facebook friends you might share in common with other Users as detailed on our Privacy Policy.
This Agreement will remain in full force and effect while you use the Service and/or have an account. Kamshare may terminate or suspend your account at any time without notice if Kamshare believes that you have breached this Agreement, or for any other reason, with or without cause, in our sole discretion. Upon such termination or suspension, you will not be entitled to any refund of unused fees for In App Purchases as detailed on our Payment Policy. Kamshare is not required to disclose, and may be prohibited by law from disclosing, the reason for the termination or suspension of your account. After your account is terminated for any reason, all terms of this Agreement survive such termination, and continue in full force and effect, except for any terms that by their nature expire or are fully satisfied.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. YOU UNDERSTAND THAT Kamshare CURRENTLY DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR SCREENINGS ON ITS USERS. THE Kamshare ALSO DOES NOT INQUIRE INTO THE BACKGROUNDS OF ALL OF ITS USERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS USERS.
Kamshare is not responsible for the conduct of any User. In no event shall Kamshare, its affiliates or its partners be liable (directly or indirectly) for any losses or damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service including, without limitation, death, bodily injury, emotional distress, and/or any other damages.
The Service provides a mobile application that lets their Users create Pages and content to be shared across multiple mediums and with multiple Users. The Service primarily adds the pictures collected through the mobile application into a shared gallery where Users can access content voluntarily generated by other Users.
To use the Service, you must have access to the Internet, either directly or through devices that access web-based content, and you must pay any fees associated with Internet access.
The Service may include certain communications from us, such as service announcements, administrative messages and any other type of announcement or notification we deem necessary. You may not access the Service by any means other than through the interfaces provided by the Service.
The Service is distributed free of charge but there are items that are paid through "In App Purchases".
You agree that you will not:
a. upload, post, transmit or otherwise make available any Content that is mean-spirited, unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy (up to, but not excluding any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically or otherwise objectionable;
b. harm minors in any way;
c. impersonate any person or entity, including, but not limited to, a Kamshare official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
d. upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
e. upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;
f. upload, post, or transmit unsolicited commercial email or "spam". This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam", such as (i) promoting a site with inappropriate links, titles, descriptions, or (ii) promoting your site by posting multiple submissions;
g. upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
h. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
i. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
j. "stalk" or otherwise harass another;
k. promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices;
l. offer for sale or sell any item, good or service that (i) violates any applicable federal, state, or local law or regulation, (ii) you do not have full power and authority under all relevant laws and regulations to offer and sell, including all necessary licenses and authorizations, or (iii) we determine, in our sole discretion, is inappropriate for sale through the Service;
m. use the Service as a forwarding service to another web site or mobile application;
n. solicit a third party’s passwords or personal identifying information for unlawful or phishing purposes;
o. exceed the scope of the Service that you have signed up for; for example, by accessing and using the tools that you do not have a right to use, or deleting, adding to, or otherwise changing other peoples Comments or Content;
p. upload, post or otherwise transmit any Content that is intended to take advantage of a User. Such content may include, but is not limited to, "get rich quick", "get paid to surf", pyramid/MLM, or other dubious schemes.
q. upload, post or otherwise transmit any Content that is adult in nature, such as any nudity in a sexual context, any Content revealing exposed genitalia, or any Content with adult themes.
r. express or imply that any statements you make are endorsed by Kamshare without our specific prior written consent.
s. access the Service in a jurisdiction in which it is illegal or unauthorized;
t. use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
u. forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the Service (either directly or indirectly through use of third party software).
v. modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service any Software used on or for the Service, or cause others to do so.
w. post, use, transmit or distribute, directly or indirectly, (e.g. screen scrape) in any manner or media any content or information obtained from the Service other than solely in connection with your use of the Service in accordance with this Agreement.
The Service does not claim ownership of your Content, but you give us your permission to host your Content on the Service.
The technical processing and transmission of the Service, including Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
All information, data, text, software, music, sound, photographs, graphics, video, messages, goods, products, services or other materials you post on the Service are the sole responsibility of the person from which such Content originated. You are responsible for all Content that you upload, post, transmit or otherwise make available via the Service.
These types of contents are not allowed on The Service:
a. Adult: involving nudity in a sexual context, exposed genitalia or adult themes
b. Copyrighted Content: music, movies or games that you do not own the rights to
c. Spam/SEO: a page whose sole purpose is to gain Google ranking, Facebook "likes", etc
d. Phishing: a page meant to trick users into providing their username and password
e. Illegal Content: content which may be illegal in the United States
f. Scams: get rich quick, pyramid/MLM, or other dubious schemes
g. File Hosting: including pages or images that are not created with the Service
This list is a quick reference and is not meant to be complete.
By using the Service, you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will we be liable for your Content or the Content of any third party, including, but not limited to, for any errors or omissions in your Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Service.
You acknowledge that we do not pre-screen Content, but that we shall have the right (but not the obligation) to refuse, move or delete any Content that is available via the Service. We shall also have the right to remove any Content that violates these Terms or is otherwise objectionable in our sole discretion.
You must evaluate, and bear all risks associated with, the use of any Content.
You may not rely on any Content created by us.
You acknowledge and agree that we may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect our rights, property, or personal safety and those of our users and the public.
You are solely responsible for the content and information that you post, upload, publish, link to, transmit, record, display or otherwise make available (hereinafter, “post”) on the Service or transmit to other users, including text messages, chat, videos (including streaming videos), photographs, or profile text, whether publicly posted or privately transmitted.
You may not post as part of the Service, or transmit to Kamshare or any other User (either on or off the Service), any offensive, inaccurate, incomplete, abusive, obscene, profane, threatening, intimidating, harassing, racially offensive, or illegal material, or any material that infringes or violates another person’s rights (including intellectual property rights, and rights of privacy and publicity).
You represent and warrant that (i) all information that you submit upon creation of your account, including information submitted from your Facebook account, is accurate and truthful and that you will promptly update any information provided by you that subsequently becomes inaccurate, incomplete, misleading or false and (ii) you have the right to post the Content on the Service.
You understand and agree that Kamshare may, but is not obligated to, monitor or review any Content you post as part of a Service. Kamshare may delete any Content, in whole or in part, that in the sole judgment of Kamshare violates this Agreement or may harm the reputation of the Service or Kamshare.
By posting Content as part of the Service, you automatically grant to Kamshare, its affiliates, licensees and successors, an irrevocable, perpetual, non- exclusive, transferable, sub-licensable, fully paid-up, worldwide right and license to (i) use, copy, store, perform, display, reproduce, record, play, adapt, modify and distribute the Content, (ii) prepare derivative works of the Content or incorporate the Content into other works, and (iii) grant and authorize sublicenses of the foregoing in any media now known or hereafter created. You represent and warrant that any posting and use of your Content by Kamshare will not infringe or violate the rights of any third party.
You may not post, upload, display or otherwise make available Content that:
a. that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
b. advocates harassment or intimidation of another person;
c. requests money from, or is intended to otherwise defraud, other users of the Service;
d. involves the transmission of “junk mail”, “chain letters,” or unsolicited mass mailing or “spamming” (or “spimming”, “phishing”, “trolling” or similar activities);
e. promotes information that is false or misleading, or promotes illegal activities or conduct that is defamatory, libelous or otherwise objectionable;
f. promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture- installed copy-protect devices, or providing pirated images, audio or video, or links to pirated images, audio or video files;
g. contains video, audio photographs, or images of another person without his or her permission (or in the case of a minor, the minor’s legal guardian);
h. contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
i. provides material that exploits people in a sexual, violent or other illegal manner, or solicits personal information from anyone under the age of 18;
j. provides instructional information about illegal activities such as making or buying illegal weapons or drugs, violating someone’s privacy, or providing, disseminating or creating computer viruses;
k. contains viruses, time bombs, trojan horses, cancelbots, worms or other harmful, or disruptive codes, components or devices;
l. impersonates, or otherwise misrepresents affiliation, connection or association with, any person or entity;
m. provides information or data you do not have a right to make available under law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information);
n. disrupts the normal flow of dialogue, causes a screen to “scroll” faster than other users are able to type, or otherwise negatively affects other users’ ability to engage in real time exchanges;
o. solicits passwords or personal identifying information for commercial or unlawful purposes from other users or disseminates another person’s personal information without his or her permission; and
p. publicizes or promotes commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
Kamshare reserves the right, in its sole discretion, to investigate and take any legal action against anyone who violates this provision, including removing the offending communication from the Service and terminating or suspending the account of such violators.
Your use of the Service, including all Content you post through the Service, must comply with all applicable laws and regulations. You agree that Kamshare may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary, such as to: (i) comply with legal process; (ii) enforce this Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service or allow you to use the Service in the future; or (v) protect the rights, property or personal safety of Kamshare or any other person.
You agree that any Content you place on the Service may be viewed by other users and may be viewed by any person visiting or participating in the Service.
We retain the right to terminate any account or User who has violated any of the above prohibitions.
We further reserve the right to withhold, remove and or discard any Content available, with or without notice if deemed by us.
For avoidance of doubt, we have no obligation to store, maintain or provide you a copy of any content that you or others provide when using the Service.
We may establish general practices and limits concerning use of the Service and may modify such practices and limits from time to time with or without notice to you.
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
Listing of offered products on the Service could be used only for lawful purposes by Users of the Service. You could not frame or utilize framing techniques to enclose any hallmark, logo, copyrighted image, or most proprietary details (consisting of images, text, page layout, or type) of Kamshare without express composed consent.
You might not use any meta tags or any various other "unseen text" utilizing Kamshare's name or trademarks without the express written consent of Kamshare.
You agree not to offer or modify any content found on the Service consisting of, however not limited to, names of Users and Content, or to recreate, display, openly perform, distribute, or otherwise make use of the Content, in any way for any public function, in connection with services or products that are not those of Kamshare, in other way that is likely to trigger confusion among consumers, that disparages or challenges Kamshare or its licensors, that dilutes the strength of Kamshare or its licensor's residential property, or that otherwise infringes Kamshare or its licensor's copyright rights.
You also agree to abstain from abusing any of the Content that appears on the Service. The use of the Content on any other website, mobile application or in a networked computer system environment for any purpose is prohibited.
Any code that Kamshare develops is likewise secured by Kamshare copyright, and you may not copy, modify or adjust such code.
Kamshare has no duty to keep track of any products published, transferred, or connected to or within the Service.
If alerted by a User of any products which allegedly do not conform to these Terms, Kamshare could in its single discernment explore the allegation and figure out whether to take other actions or ask for the removal or get rid of the Content. Kamshare has no liability or duty to Individuals for efficiency or nonperformance of such activities.
You are connecting with us electronically when you go to the Service or send out emails to us.
You concur that all contracts notifications, disclosure, and various other communicates that we provide to you digitally please any legal requirements that such communications be in writing.
Kamshare may provide you with notices, including those regarding changes to this Agreement, using any reasonable means now known or hereafter developed, including by email, regular mail, SMS, MMS, text message or postings in the Service. Such notices may not be received if you violate this Agreement by accessing the Service in an unauthorized manner. You agree that you are deemed to have received any and all notices that would have been delivered had you accessed the Service in an authorized manner.
If you utilize the Service, you are accountable for maintaining the confidentiality of the process and the Users. You also accept not to reveal any personally identifiable information, consisting of, however not limited to, first and last names, credentials, or various other details of a personal nature ("Personal Data") from the Service. Your disclosure of any Personal Data might result in the immediate termination of your account. Kamshare additionally reserves the right to refuse service, terminate accounts, and remove or edit Content at its sole discernment.
Kamshare does not guarantee the truthfulness or represent, precision, or dependability of Content on the site, consisting of Personal Data. Each Individual is accountable for upgrading and changing any pertinent account info when essential to preserve the truthfulness, precision, or reliability of the details.

If you post an evaluation or send comments, and unless Kamshare suggests otherwise, you grant Kamshare a nonexclusive, royalty-free, permanent, irrevocable, and completely sub licensable right to utilize, recreate, modify, adjust, release, equate, create derivative works from, distribute, and screen such content throughout the world, in any media. You grant Kamshare and sublicenses the right to utilize your name in connection with such Content, if they choose. You represent and require that You own or otherwise control all the rights to the content that You post; that the content is accurate; that use of the content You supply does not violate this policy and will not trigger injury to anyone or entity; which You will indemnify Kamshare for all claims resulting from Content You supply. Kamshare has the right but not the commitment to edit and keep track of or eliminate any task or Content. Kamshare takes no duty and assumes no liability for any content published by You or any 3rd party.
You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of the Service. Kamshare reserves the right to investigate complaints or reported violations of our Legal Terms and to take any action we deem appropriate, including but not limited to canceling your account, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information, as allowed under our Privacy Policy.
The Service may contain our service marks or trademarks as well as those of our affiliates or other companies, in the form of words, graphics, and logos. Your use of the Service does not constitute any right or license for you to use such service marks/trademarks, without the prior written permission of the corresponding service mark/trademark owner. The Service is also protected under international copyright laws. The copying, redistribution, use or publication by you of any portion of the Service is strictly prohibited. Your use of the Service does not grant you ownership rights of any kind in the Service.
You agree that the Service contains proprietary information and Content that is owned by Kamshare and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary information or materials in any way whatsoever except for use of the Service in compliance with these Terms of Service. No portion of the Service may be reproduced in any form or by any means.
All copyrights in and to the Service are owned by Kamshare and/or its licensors.
Kamshare, the Kamshare logo and other trademarks, service marks, graphics, and logos used in connection with the Service are trademarks of Kamshare Corp. in the U.S. and/or other countries. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.
The materials appearing on the Service could include technical, typographical, or photographic errors. Kamshare does not warrant that any of the materials on the Service are accurate, complete, or current. Kamshare may make changes to the materials contained on the Service at any time without notice. Kamshare does not, however, make any commitment to update the materials.
The Content on Kamshare are provided "as is". Kamshare makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Kamshare does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Service or otherwise relating to such materials or on any sites linked to the Service.
Neither Kamshare nor the Service has control over the quality or fitness for a particular function of a service. Kamshare likewise has no control over the accuracy, reliability, completeness, or timeliness of the User-submitted details and makes no representations or warranties about any info on the Service.
For as long as we continue to offer the Service, we will provide and seek to update, improve and expand the Service. As a result, we allow you to access the Service as it may exist and be available on any given day and have no other obligations, except as expressly stated in this Agreement.
We may modify, replace, refuse access to, suspend or discontinue the Service, partially or entirely, or change and modify prices for all or part of the Services for you or for all our users in our sole discretion.
Kamshare IS NOT RESPONSIBLE FOR ANY DAMAGE, LOSS OF DATA, CUSTOMER INFORMATION OR VENDOR DATA, REVENUE, OR OTHER HARM TO BUSINESS ARISING OUT OF DELAYS, MISDELIVERY OR NONDELIVERY OF INFORMATION, RESTRICTION OR LOSS OF ACCESS, BUGS OR OTHER ERRORS, UNAUTHORIZED USE DUE TO YOUR SHARING OF ACCESS TO THE SERVICE, OR OTHER INTERACTION WITH THE SERVICE.
Kamshare DOES NOT WARRANT THAT (i) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
